Terms & Conditions
1. Acceptance of these terms
By accessing or using Kavopay, you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, you should not use the service.
2. About Kavopay
Kavopay is a digital platform that may provide access to airtime top-ups, account tools, transaction features, and related digital services. Some services may be offered directly by Kavopay, while others may involve third-party providers, payment partners, or infrastructure partners.
3. Eligibility
- You must be at least 18 years old to use Kavopay unless applicable law allows otherwise.
- You must provide accurate, complete, and current information during sign-up and use of the platform.
- You are responsible for ensuring that your use of Kavopay complies with the laws applicable to you.
4. Your account
To use certain features, you may need to create an account. You are responsible for maintaining the confidentiality of your login details and for all activity that occurs under your account.
- Do not share your password, OTP, or security credentials with unauthorized persons.
- You must notify us promptly if you suspect unauthorized access or suspicious activity on your account.
- We may require identity verification or additional checks before enabling certain services.
5. Permitted use
You agree to use Kavopay only for lawful and legitimate purposes. You must not:
- Use the platform for fraud, abuse, money laundering, identity theft, or other unlawful conduct
- Submit false, misleading, or stolen information
- Attempt to gain unauthorized access to systems, accounts, databases, or APIs
- Interfere with or disrupt the normal operation, security, or integrity of the service
- Use automated tools, bots, or scripts in a way that harms the platform or other users
6. Service availability
We aim to keep Kavopay available and functioning reliably, but we do not guarantee uninterrupted, error-free, or always-available service. Access may be affected by maintenance, updates, third-party dependencies, technical failures, connectivity issues, or regulatory requirements.
7. Transactions and processing
Where Kavopay supports transactions or service requests, you are responsible for reviewing your details carefully before submitting them. This includes, where applicable, recipient details, phone numbers, amounts, network selections, and other transaction inputs.
- Submitted transactions may not always be reversible once processing has started.
- Processing times may vary depending on system conditions and third-party providers.
- Successful payment does not always mean instant final completion if additional verification is required.
7.1 Bank transfers and withdrawal timing
Transfers from your Kavopay wallet to an external bank account are processed through our payment partner, Flutterwave. While most transfers settle quickly, some transfers may take up to 2 to 5 business days to reflect in the recipient bank account, depending on Flutterwave's settlement policy, the receiving bank's processing time, and other factors outside our control. This delay does not mean a transaction has failed — you can check the transaction status in your transaction history at any time.
Where a sender reports a transaction as sent in error, unauthorized, or fraudulent and provides supporting proof (e.g. a receipt or transaction reference), the transaction amount may be investigated and, where warranted, reversed back to the sender in line with Flutterwave's dispute-resolution process and applicable banking rules. We may place a transaction under review while a reported dispute is being investigated.
7.2 Refunds on failed purchases
For purchases made on Kavopay (including airtime, data, bill payments, virtual numbers, and domain registrations), where a purchase does not complete successfully after your wallet has been debited, the amount charged is automatically refunded to your Kavopay wallet. In most cases this refund happens instantly; in rare cases involving a third-party provider outage, it may take slightly longer, but you will not be left out of pocket for a purchase that did not go through.
8. Third-party services
Kavopay's services are made possible in part through partnerships with third-party providers. Our primary payment processing partner is Flutterwave, which we rely on to process wallet funding, transfers, and payment settlement. We also work with other infrastructure, cloud, verification, and telecom-related partners as needed to operate the platform. We are not responsible for failures, delays, pricing changes, restrictions, or outages caused by these third-party providers, though we work with them to resolve issues affecting your use of Kavopay.
9. Fees and charges
Certain Kavopay services may attract fees, charges, or deductions. Where applicable, such fees may be displayed before you confirm a transaction or use a service. You are responsible for reviewing any applicable pricing before proceeding.
10. Verification and compliance
To comply with legal, regulatory, security, and anti-fraud obligations, we may request additional information or verification documents. We may also suspend, restrict, delay, or refuse services where verification is incomplete, inconsistent, suspicious, or legally restricted.
11. Suspension and termination
We may suspend, restrict, or terminate your access to Kavopay at our discretion where necessary to protect the platform, comply with legal obligations, investigate suspicious activity, or respond to misuse.
- Breach of these Terms & Conditions may result in account restriction or closure.
- We may take action without prior notice where urgent security or legal concerns exist.
- You may stop using Kavopay at any time, but some obligations may survive termination.
12. Intellectual property
Kavopay, including its branding, interface elements, text, graphics, logos, design, and related content, is protected by applicable intellectual property laws. You may not copy, reproduce, modify, distribute, reverse-engineer, or commercially exploit any part of the service except as permitted by law or by our written permission.
13. Privacy
Your use of Kavopay is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. By using Kavopay, you acknowledge that your information may be processed in accordance with that policy.
Kavopay's approach to preventing money laundering and terrorism financing, including the settlement and transaction-reversal matters described in Section 7.1, is set out in our AML/CFT Compliance Policy.
14. Disclaimers
Kavopay is provided on an “as available” and “as is” basis to the extent permitted by law. While we work to maintain quality, we do not guarantee that the service will always be uninterrupted, fully accurate, fully secure, or suitable for every purpose or device.
15. Limitation of liability
To the fullest extent permitted by applicable law, Kavopay and its operators, staff, partners, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, business, goodwill, or data arising from your use of, or inability to use, the platform.
Nothing in these terms excludes liability where such exclusion is not permitted by law.
16. Indemnity
You agree to defend, indemnify, and hold harmless Kavopay and its affiliates, personnel, and partners from claims, liabilities, damages, losses, and expenses arising out of your misuse of the platform, violation of these terms, or breach of applicable law or third-party rights.
17. Changes to the service or terms
We may update, suspend, discontinue, or modify parts of Kavopay and may revise these Terms & Conditions from time to time. When material changes are made, we may update the version information on this page and, where appropriate, notify users through the platform or by email.
18. Governing law
These Terms & Conditions are governed by the laws applicable to the operation of Kavopay, unless otherwise required by local consumer protection laws or mandatory legal rules in your jurisdiction.
